Hereinafter referred to as "AV Mekaniek BV",
Declares the following:
AV Mekaniek BV processes personal data in execution of the order entrusted by the client, as well as in case of contact via the contact form and/or the visit to the website(www.husck.eu). This either as a controller or as a processor depending on the specific circumstances.
AV Mekaniek BV is the data controller insofar as the processing of personal data takes place for its own purposes and AV Mekaniek BV itself determines the means for this. Insofar as personal data of data subjects are processed on behalf of the client, AV Mekaniek BV acts as processor.
AV Mekaniek BV recognises the importance of secure processing of personal data. In this sense, both AV Mekaniek BV and the client acknowledge that any processing will take place in accordance with the prevailing national regulations, including the Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data, as well as Regulation (EU) 2016/679 (hereinafter: AVG) in force since 25 May 2018 and to comply with them. In the event of any substantive legislative changes, AV Mekaniek BV undertakes to amend the privacy policy accordingly.
The privacy policy as well as any changes can be consulted at any time on the website of AV Mekaniek BV, www.husck.eu.
Definitions
For a proper understanding of this privacy policy, the following terms shall have the following meanings:
AVG: Regulation No 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, also referred to as General Data Protection Regulation or GDPR;
Personal data: any information relating to an identified or identifiable natural person such as a name, e-mail address, location data, an online identifier or one or more elements characterising physical, physiological, genetic, psychological, economic, cultural or social identity;
Data subject: the identified or identifiable natural person; data subject consent: any freely given, specific, informed and unambiguous expression of will by which the data subject consents, by means of a statement or an unambiguous active act, to the processing of personal data
Processor: a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller;
Processing: an operation or set of operations involving personal data or a set of personal data, whether or not carried out by automated means, such as the collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, transmission, dissemination or otherwise making available, alignment, combination, blocking, erasure or destruction of data;
Controller: a natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of processing personal data;
Data breach: any breach of security leading accidentally or unlawfully to the destruction, loss, alteration or unauthorised disclosure of, or unauthorised access to, data transmitted, stored or otherwise processed.
Scope of privacy policy
1. Contractual relationships
The present privacy policy applies to the contractual relationship between AV Mekaniek BV and the client or data subject and applies throughout the duration of the assignment. Deviations from the privacy policy in the case of a contractual relationship between the client or data subject and AV Mekaniek BV are permissible only if prompted by legal requirements, or following the consent, implicit or otherwise, of both parties. Substantial changes will be explicitly communicated on the website.
By consulting the website of AV Mekaniek BV(www.husck.eu) and/or by using the contact form, the person concerned acknowledges having taken cognisance of the privacy policy and agrees that AV Mekaniek BV can and may use the personal data collected, taking into account the scope of the request for which the data were provided (art. 6.1.a and 6.1.b AVG).
AV Mekaniek BV in no way guarantees the completeness, correctness and up-to-dateness of the information contained on the website, nor the content of third-party websites to which links are provided.
2. Processing of personal data
AV Mekaniek BV guarantees that personal data are collected and processed transparently and only for specified, explicit and legitimate purposes. Any processing is limited to what is necessary for the purposes for which the processing is carried out. AV Mekaniek BV ensures that the personal data are correctly registered and updated when necessary.
In connection with the services provided by AV Mekaniek BV, the personal data collected include the client's surname, first name, e-mail address, address (geolocation) and telephone number, as well as any other personal information that the client or data subject chooses to disclose in its request for information or services from AV Mekaniek BV. No data are processed that can be considered sensitive or that fall under a special category of personal data.
AV Mekaniek BVBA retains the personal data it processes for no longer than is necessary for the purpose of processing or as required by law.
Processing ground
By using the services of AV Mekaniek BV or filling out the contact form on the website and transferring personal data in doing so, the client acknowledges and accepts that these data may be processed (art. 6.1.b) AVG). However, the client and/or the person concerned remains the owner of the data made available.
For the personal data received by AV Mekaniek BV as responsible party on behalf of the client and used for marketing purposes and client management, AV Mekaniek BV falls back on the legal basis of legitimate interest consisting of the situation where the data subject is a client of AV Mekaniek BV as a result of placing an order (Art. 6.1(b) and (f) AVG), or explicitly obtained consent (Art. 6.1(a) AVG).
The customer, in his capacity as data subject, has at all times the possibility to change or withdraw the given consent, insofar as the processing thereof is solely based on his consent.

When AV Mekaniek BV is called upon, it must also have certain personal data that are necessary for the performance of the agreement.
In all processing, AV Mekaniek BV will only use those personal data that are minimally necessary in the context of the services requested.
Appropriate technical and organisational measures
AV Mekaniek BV will take appropriate technical and organisational measures to process personal data securely so as to limit the risk of destruction, loss, unauthorised alteration or processing. This will take into account industry practices, the state of the art, the nature, scope, context of the processing, processing purposes and the possible associated risks to the rights and freedoms of individuals concerned. Upon written request, AV Mekaniek BV shall provide detailed information on the security policy applied.
Subcontractors and processors
AV Mekaniek BV uses sub-processors, including, but not limited to, external courier services, which process personal data on behalf of and under the supervision of AV Mekaniek BV. Such processing will at all times be limited to what is strictly necessary for the performance of the respective assignment.
AV Mekaniek BV shall ensure that its designated processors, including its employees and subcontractors, process personal data in accordance with applicable law and hereby undertake, contractually or otherwise, to take the necessary technical and organisational security measures on the basis of Art. 28 AVG.
The employees and sub-processors of AV Mekaniek BV have contractually undertaken to observe the confidentiality of personal data.
The sub-processor decides autonomously on the way the personal data are processed, taking into account the risks associated with its expertise. In the absence of the same expertise, AV Mekaniek BV, as the processing controller, is not liable for any unlawful processing carried out as a result of an erroneous assessment by the subprocessor. AV Mekaniek BV therefore bears no responsibility in the event of loss or corruption of data, theft of data, viruses or other attacks on the computer systems and (cloud) servers of the sub-processor.
Transfer of personal data to third parties
Except in relation to the employees and sub-processors involved in the provision of services, AV Mekaniek BV will not exchange personal data with third parties, except in case of explicit consent, at the request of the data subject, judicial authorities or when required by law. In the latter case, AV Mekaniek BV will inform the data subject without delay of the request by the relevant bodies and/or authorities.
Data processing within the European Union
AV Mekaniek BV endeavours to limit the transfer and processing of personal data to countries within the European Economic Area or to countries that ensure an adequate level of protection equivalent to that guaranteed under the AVG and this Privacy Policy, taking into account the intended processing, scope and category of personal data to be processed, the country of destination and the rules of law applicable in the country concerned. In the case of processing outside the boundaries of processing outside the European Economic Area, AV Mekaniek BV will provide further explanation upon written request of the data subject.
The rights of the data subject
Within the framework of the AVG, the data subject has the following rights in relation to the personal data collected and processed (Articles 12 to 22 AVG): the right to access, the right to correct and/or supplement the data collected, the right to limit the purpose of processing, the right to data portability, the right to be forgotten and the right to object.
Questions concerning the collection and processing of personal data or an appeal to your rights as a data subject can be addressed in writing, stating reasons, to AV Mekaniek BV by e-mail to info@husck.eu or by post to Langendam 29 A1, B-9940 Sleidinge. AV Mekaniek BV processes each request without delay and provides feedback on this within a period of 30 days. In certain cases, AV Mekaniek BVBA is entitled to extend this period by two months, in which case AV Mekaniek BV will inform the data subject within 30 days of receiving the request (art. 12.3 AVG).
Retention period of personal data
AV Mekaniek BV guarantees that it will not keep the personal data collected for longer than necessary to achieve the intended purpose, except as regards accounting supporting documents and those relating to liability claims, which may justify a longer retention period according to the relevant legal provisions. Other data that may be necessary for adequate after-service or future service provision are kept anonymised to the extent possible so that they are not traceable to identifiable individuals for longer than necessary.
When retention of personal data is no longer required, they will be destroyed or deleted in a secure manner, or made available to the data subject.
Measures in the event of a data breach
AV Mekaniek BV takes the necessary measures to prevent a loss of data. However, should such a loss occur, AV Mekaniek BV undertakes, where appropriate, to report this to the Data Protection Authority (DPA) within the statutory deadlines. This obligation to inform only applies to the extent that the data leak proves to be large-scale or involves a far-reaching impact on security.
If a data breach also poses a high risk to the rights and freedoms of the persons involved, AV Mekaniek BV, will inform the person involved without unreasonable delay.
AV Mekaniek BV shall cooperate fully with the competent authorities by providing the necessary information and mitigating the consequences of the breach.
Other provisions
AV Mekaniek BV guarantees the necessary support to data subjects to fulfil their obligations, except in the case of information that is confidential or may not be communicated because of a legal regulation. In case of nullity of one or more provisions of this privacy policy, these provisions will be interpreted in accordance with the AVG. The nullity of one of the provisions shall not affect the validity of the remaining provisions of this privacy policy. If discrepancies arise between the privacy policy and the agreement entered into between AV Mekaniek BVBA and the client or data subject, the provisions of the latter shall prevail.
AV Mekaniek BV reserves the right to amend the privacy policy should this prove necessary to comply with its rights and/or obligations under the AVG. Material changes will always be announced on the website. You are advised to visit the website regularly to keep up-to-date with recent changes.
This privacy policy is governed exclusively by Belgian law. Only the courts in the judicial district of AV Mekaniek BV's registered office have jurisdiction to hear any disputes arising herefrom.
